Executive Action on Data Protections Made Possible by Withdrawal of Dangerous “Digital Trade” Proposals

Statement by Arthur Stamoulis, Executive Director, Trade Justice Education Fund

Washington, D.C. — In response to the anticipated release today of President Biden’s executive order to protect Americans' personal data <https://click.actionnetwork.org/ss/c/u001.XaF8mXqsA6b2dSPmhsleMZVPOrXAv2mSfL-XmpbD727cJsP6YLWCp-nLuGtzRoUQx9fXY98VyZ03HNFMJeNN7mHeBGDt3XlaiczaMwDlA_RpPRf07ZjRI38AkXf744RUiZ0pDjrUZMkBAlpBimBh-0An1k3XDfBSn4U_9YVv36-XacddLyl6f70bFqeCHISqYEpOhDf4X8lVTgOMklxNzK8UeU0ZhWlIIQKozyFv3hwdS9ikXdt3L7gTTJUOk_1NjHfSDg1fV3s797Fr2mDnlngbRYb4k9JIALLBMAYJeiG6WeN-kE9D-p_aDiTrEAl5S_V8UeFczk5HqALvsAmt49LUep6YHUYLi1NAsR9aksPj3mJwEIap2jJo-tQ8yRSSEOKhT7M5kbDrUKLJdAm5hYL8ceTv7yFmq2DJls59BNCNx8pQGE9-SgvubzRDjAkCLmusnes7ki7fIXxwSA85hJsuMxwdQRv0gGE42ai0DgDdhHequqzdPCWsqofCRnTQfXr5OeXGRoejPv7My8Mce1VNldft6f804mrxJSrrY37mSrPBufxsRiYBz-2Ps8Hna4YJWwsuoeJrHUdbUPkf58A75OC_n5Y_SvhNAwTZVZG-qtk5cBmdIih-ygQYiMFN/448/1zXMv_rrSQGCfnSj-UdNDg/h0/h001.a5Gjtd3Em1BDSp9SXb3khN6w7X0WK2arl0otvu4rp1w>, Arthur Stamoulis, the executive director of the Trade Justice Education Fund, issued the following statement:

"President Biden’s executive order forbidding Americans’ sensitive personal data from being sold to bad actors overseas is another indication that the era of Big Tech firms' ability to ship, process and store people’s personal information anywhere they choose without regard to privacy and data security standards is coming to an end.

“The ability for a U.S. president to take this type of action was preserved and protected last fall when the Biden administration withdrew U.S. support for Trump-era ‘digital trade’ proposals that largely forbade government regulation of data and that would have undermined consumer privacy, AI accountability, worker rights and anti-monopoly policies. That decision was rightly praised by labor, consumer, civil rights and small business advocates <https://click.actionnetwork.org/ss/c/u001.SEgofQhSb9pGg8bz5XQG3WVc92UtlURckeW_LeToflToiesHbibapkbcWv_DpLTnCY9v9ZNfOcpXHsBq7HoCjJPvjDmhvCKAEQIYHIDF33rjZy_FoqnrotlH3KepyXooKYOrZEbU7XgZdExptmlCLREmP1mZDuuKzFwNJVYeSWerwLdDdX2RUVun1n3rHfhxVee_95O03ge26ihW7c952Zyy8umzQMgg6p4eLYSC3yTDhJ7hHG6GwkoLHfgAqNdiPqNbMKXDsvcmt_9WGjJU-To3hyHJ3Cr27oZkH9EaaehEHzSQx3gOky93uKZ_QEt3gsolIo3etF0OW9X6ulkfw5gJGZQBghXTSurLI2amypi7CH-Idx_geHro6QVSZMFPUeGqLelJMKIZyENx6LeOelBHGJiUD4TEvbxduhDFTjcScNDpabF-9VtUH-ybFXffDjqAOpVS8otBdD2lQwPftGZ7D5hMvRdjJQVOsjnGAjT8v_gSjJXCrIGpX34O80L8Cn8eGPZGB-pY2oF-JiOTVs1WcuPc9jy1pvGu-TKQKHHuQzMm7l9HBVzot_kTuMce/448/1zXMv_rrSQGCfnSj-UdNDg/h1/h001.FNM9KAyZUfbeAZCHb56CULZJaO9XMSErErG1nwjdrfY> across the country and around the world.

“Unlike corporate lobby groups’ intentional obfuscation in the debate over cross-border data flows, the president's executive order distinguishes between transfers of public and private information. People everywhere deserve to access the type public information found in media outlets' websites, Wikipedia and other public sources; the same does not hold true for private information such as personal health and financial data or individuals' geolocation.

"Today’s executive order is another step towards ensuring that privacy finally takes priority over corporations’ desire to profit off our families’ data free from any commonsense restraints."
